Selling Terms

1. Eligibility
You must be legally entitled to sell the items you submit to PokeOutpost.
By submitting items, you confirm that:
- You are the legal owner of the items, or have full authority from the owner to sell them.
- The items are not stolen, counterfeit, fraudulent or subject to any third-party claim.
- The information you provide to us is accurate and complete.
- You are legally permitted to enter into an agreement to sell the items.
We may request additional information or proof of ownership where reasonably necessary.
2. Items We Purchase
PokeOutpost may purchase eligible items including:
- Pokémon trading cards
- Other trading card game products
- Single cards
- Graded cards
- Sealed products
- Collections and bulk card lots
- Accessories and related collectible products
We are not required to purchase every item submitted and may refuse any item or collection at our discretion.
3. Condition and Authenticity
All items are subject to inspection.
When assessing an item, we may consider:
- Authenticity
- Condition
- Edition and set
- Language
- Rarity
- Market demand
- Current market value
- Completeness
- Sealed or unsealed condition
- Damage, wear or alterations
Items that are counterfeit, altered, tampered with or otherwise believed to be fraudulent will not be purchased.
4. Valuation and Offers
Any valuation or purchase offer provided by PokeOutpost is based on our assessment of the items and the information available to us at the time.
Offers may be affected by changes in market prices, demand, condition or availability.
An initial estimate or valuation is not a guaranteed final purchase price.
The final offer will only be confirmed after the items have been received and inspected.
5. Acceptance of an Offer
Where PokeOutpost provides you with a final purchase offer, you may choose whether to accept it.
If you accept the offer, you agree to sell the relevant items to PokeOutpost for the agreed amount, subject to these Terms.
Once accepted, the transaction may not be cancelled where the items have already been transferred to PokeOutpost, except where required by applicable law or where we agree otherwise.
6. Changes to an Offer
If our inspection identifies a significant difference between the information supplied and the actual condition, authenticity, quantity or type of items received, we may revise the offer.
If the revised offer is lower than the original offer, we will notify you where reasonably practicable and explain the reason for the change.
7. Payment
Payment will only be made once the relevant items have been received, inspected and the purchase price has been agreed.
Payment methods may include bank transfer or another payment method offered by PokeOutpost.
We may delay payment where additional verification, fraud prevention or ownership checks are reasonably required.
8. Shipping Items to PokeOutpost
You are responsible for packaging items appropriately before sending them to us unless we have agreed otherwise in writing.
Cards and other valuable collectibles should be securely packaged to reduce the risk of:
- Bending
- Scratching
- Water damage
- Crushing
- Loss of items
Unless otherwise agreed, you are responsible for the items until they are safely received by PokeOutpost.
We strongly recommend using a tracked and appropriately insured delivery service for valuable items.
9. Items Damaged in Transit
PokeOutpost is not responsible for damage, loss or theft occurring before items are received by us where the customer arranged the delivery.
If items arrive damaged, we may assess the damage before deciding whether they can be purchased and at what price.
10. Ownership Transfer
Ownership of items purchased by PokeOutpost will transfer to PokeOutpost once the sale has been completed and payment has been made, unless otherwise agreed.
After ownership has transferred, PokeOutpost may resell, grade, display, bundle or otherwise dispose of the items.
11. Personal Information
You may be required to provide information necessary to process your sale, including your name, contact details, payment information and delivery information.
Your personal information will be handled in accordance with our Privacy Policy.
12. Incorrect or Misleading Information
If you knowingly provide false, misleading or incomplete information about an item, we may:
- Reject the item.
- Revise or cancel an offer.
- Refuse future transactions.
- Cancel a transaction where legally permitted.
- Take further action where appropriate.
13. Counterfeit or Suspected Stolen Items
PokeOutpost takes counterfeit and stolen products seriously.
We reserve the right to refuse suspicious items and may retain or report items where required by law or where reasonably necessary to protect against fraud or criminal activity.
We will not knowingly purchase counterfeit goods.
14. Bulk Collections
For bulk collections, the final purchase price may depend on the total quantity, composition and condition of the collection.
We may inspect collections individually or use sampling and other appropriate valuation methods depending on the size and nature of the collection.
The final offer will be based on the collection actually received.
15. Unclaimed or Rejected Items
Where a sale does not proceed and items are to be returned, PokeOutpost may require the customer to provide suitable delivery details and, where applicable, pay reasonable return postage costs.
If we are unable to contact you regarding rejected or unclaimed items, we may retain the items for a reasonable period while attempting to contact you.
Where items remain unclaimed after reasonable attempts to contact you, we may deal with them in accordance with applicable law.
16. Right to Refuse a Transaction
PokeOutpost reserves the right to refuse any proposed purchase.
We may refuse a transaction for reasons including:
- Suspected counterfeit items
- Suspected stolen property
- Unsatisfactory condition
- Incorrect or misleading information
- Items outside our purchasing requirements
- Commercial or operational reasons
- Fraud prevention or compliance requirements
17. Market Prices
Trading card and collectible prices can change quickly.
An item's market value may increase or decrease between an initial enquiry and final inspection.
PokeOutpost is not responsible for changes in market value after an offer has been made or accepted unless otherwise required by law.
18. No Guarantee of Purchase
Submitting an enquiry or collection does not guarantee that PokeOutpost will purchase your items.
All purchases are subject to inspection and acceptance.
19. Limitation of Liability
To the extent permitted by law, PokeOutpost will not be responsible for indirect or consequential losses arising from a proposed sale.
Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.
20. Changes to These Terms
PokeOutpost may update these Selling Terms from time to time.
The version applicable to your transaction will generally be the version in effect when you agree to the relevant purchase arrangement, unless otherwise required by law.
21. Governing Law
These Selling Terms are governed by the laws of England and Wales.
Any disputes relating to these Terms will be subject to the applicable courts of England and Wales, unless applicable law requires otherwise.
